B.C. pair dispute who lent whom $3,750

Neither party to a B.C. Civil Resolution Tribunal dispute fully explained why they allegedly gave each other money.

B.C.’s Civil Resolution Tribunal has ordered a man to pay a woman $3,550 although he claims he lent her a similar amount of cash.

Amansukhdeep Kaur told tribunal member Sarah Orr she lent $3,750 to Manroop Singh Sangha, who has failed to repay her. She claimed $3,750 as repayment of the loan.

Sangha told the tribunal he lent Kaur $3,750 in cash, and the money she paid him was for repayment of that loan.

“He says he does not owe the applicant anything,” Orr said in her Jan. 18 decision.

The two agreed that in the fall of 2022, Kaur paid Sangha money through several e-transfers.

Orr said the two disagreed about the purpose of these payments, with Kaur saying she gave Sangha money for personal reasons.

"She did not explain how she knows the respondent or provide any further details about why she allegedly loaned him money," Orr said.

Kaur submitted evidence showing transfers of $4,150 but Orr found Kaur had included one $600 payment twice.

“I find the applicant paid the respondent a total of $3,550 through three separate e-transfers in October and November 2022,” Orr said.

She said Sangha denied borrowing money from Kaur. He said he lent Kaur cash to help her friends, and that the e-transfers from Kaur were loan repayments.

“He provided no other details about the date or terms of the alleged loan,” Orr said.

The tribunal noted Sangha provided no evidence or submissions to support his position, such as a bank statement showing a withdrawal for the amount he said he loaned Kaur.

Orr said in the absence of any evidence Sangha lent Kaur money, she preferred Kaur’s version of events.

As such, Orr ordered Sangha to repay Kaur $3,550.
