Bicyclist files pothole suit against City of Vancouver

A Vancouver cyclist who claims he received multiple injuries after hitting a pothole in an East Vancouver construction zone is suing the city and construction contractors.

A Vancouver man who claims he received multiple injuries after striking an East Vancouver pothole while riding his bicycle is suing the City of Vancouver.

Jason Rupert Shorter, in a notice of civil claim filed in B.C. Supreme Court May 30, asserts he was riding his bike eastbound on Frances Street approaching Clark Drive.

Shorter claims that, as he approached Clark, he was directed to the north side of Frances by a traffic controller in a construction area “when suddenly and without warning [he] struck a pothole.”

Named as defendants in the case are the City of Vancouver, Ansan Industries Inc. and ABC Company.

The claim said Ansan was contracted by the city for traffic services while ABC was the contracted construction firm.

Shorter claimed the incident resulted in multiple rib fractures, a punctured lung, a shoulder injury, joint separation, contusions, abrasions and bruising.

Claiming multiple forms of negligence on the part of the defendants, Shorter is seeking various damages, including loss of future and past income, loss of earning capacity and health-care costs.

None of the allegations have been proven in court.
