NEB bumps back deadline for commenters in Kinder Morgan hearing

Comments must file letters by Aug. 18 but can ask for an extension

The City of New Westminster is concerned about a range of issues related to the proposed twinning of the Trans Mountain Pipeline - including potential impacts on the Brunette River and the fire department's ability to respond to a pipeline-related emergency.

Participants in the National Energy Board’s Kinder Morgan pipeline may want to take note of a deadline change for filing letters of comments.

The NEB recently pushed the date back to Aug. 18 from Sept. 3, just six days after the NEB plans to release the second round of draft conditions for the project.

“We expect six days should be sufficient time for comment writers to provide comments on draft conditions in their letter of comment,” wrote Tara O’Donovan in an email to the NOW. “If any comment writers do not view six days as providing enough time, they can request an extension.”

The original deadline was July 23, which would have given commenters no chance to offer feedback on the draft conditions, but the NEB moved that date to Sept. 3 after the City of Chilliwack asked for an extension. However, that Sept. 3 date was chosen in error, and the NEB’s position is it’s now correcting the mistake. The NEB is set to release the draft conditions on Aug. 12.

There are two kinds of participants in the NEB hearing. Intervenors have relevant info or expertise or are directly affected by the project. They have a higher level of standing in the hearing and can present final arguments. Commenters can only write a letter outlining their concerns or support for the project.
