Jeff Caron was 28 years old when a retaining wall fell on him while he was working in a trench in North Burnaby. Taxpayers could be on the hook after a WorkSafeBC report found the city failed to provide information that could have prevented the death of a construction worker in 2012.

It’s been more than four years since a Calgary man was killed at a Burnaby worksite, but there’s still no indication whether any of the parties involved will be facing criminal charges.

In 2014, WorkSafeBC released its investigation report into the fatality, which happened on Oct. 11, 2012 when a retaining wall collapsed on two construction workers who were laying pipe in a trench. One of the workers, Thomas Richer, was seriously injured, and the other worker, Jeff Caron, was killed.

WorkSafeBC’s investigation determined that both the City of Burnaby and the contractor the workers worked for, J. Cote & Sons Excavating Ltd., were responsible for the accident that killed Caron and injured Richer.

With the report complete, WorkSafeBC decided to forward the case to the Burnaby RCMP to have them determine whether or not someone should be held criminally responsible for the death.

It’s been nearly two years since the file was passed to the RCMP, and there is no new information to report, according to Cpl. Daniela Panesar, spokesperson for the Burnaby detachment.

Panesar said she spoke with the major crimes investigator assigned to the case, and he said the investigation is ongoing.

WorkSafeBC is not involved in the criminal investigation and would not comment on the case at this time.
